Family laws in India
My Blog will provide useful information on Family laws in India.
For couples who cannot have children, a surrogate mother is a viable and increasingly popular option. A surrogate mother is a woman who has agreed to become pregnant in order to deliver a child specifically for a couple with which she has a contract. Surrogate mothers can be the baby's genetic mother, in which case her own eggs are fertilized; or she may be a gestational carrier, and have an embryo implanted in her uterus where it can develop into a baby. Since surrogacy is relatively new, the rights of surrogate mothers have raised many discussions and debates.
Parental Rights
In most surrogate contracts, the woman who carries the baby relinquishes all parental rights to the infant once it is born. This means that the man who has provided the sperm for fertilization retains sole custody of the child and his wife can adopt. He is also listed as the child's father in the court orders obtained prior to the delivery. However, these consent forms are usually signed after the birth of the child, so the surrogate mother can change her mind.
In an embryo transfer situation, the pre-birth court papers list the couple as the child's biological parents. Their names are listed on the birth certificate and the surrogate mother has no rights to the child at all.
Medical Expenses
Under a surrogacy contract, the surrogate mother has the right to have all of her medical and other expenses covered as long as they relate to her pregnancy. Some non-related medical expenses are also covered because other conditions could affect the infant if they are not taken care of in a timely manner.
Counseling
The surrogate mother has the right to choose professional counseling from the early stages of discussing surrogacy throughout the pregnancy period and beyond. The counseling can either involve her as an individual or her and the intended parents.
States Supporting Surrogacy
The rights of surrogate mothers only apply in states in which surrogacy is accepted as legal. There is no uniform federal laws regarding surrogacy and the states have varied laws. According to justice roman, Alaska does not have any laws regarding surrogacy. In North Carolina, however, surrogacy contracts are acceptable but a judge still has final say about who should raise the child based on the child's best interests. Other states, such as Michigan, have strict laws forbidding surrogacy and even make these contracts criminal acts, as they work against the best interest of the child involved. According to the Human Rights Campaign website, there are six states as of 2009 that expressly permit surrogacy contracts, including Arkansas, California, Illinois, Massachusetts, New Jersey and Washington. Even among those states, there are differences based on compensation, type of surrogacy and more.
Privacy
Surrogate mothers have the right to privacy. This means when they sign up through an agency that matches surrogates with couples looking for a surrogate, their privacy is protected until all the parties meet together. Even then, the surrogate mothers have a right to their own privacy during the pregnancy as long as they are not doing anything that could harm the fetus

After arranging the travel details, the Intended Parents would arrive in Delhi, India. We will arrange for airport pick-up and look after you during your entire stay. We will also arrange for an English speaking driver/guide to be with the Indented Parents during their entire stay in Hyderabad. They will also have a vehicle at their disposal. Should you wish to go on for some sight- seeing and explore India, our travel agent will help you plan your itinerary, reservations and take care of other minor details.
After the IVF procedure is carried out, and upon successful pregnancy we will house the Surrogate Mother if necessary, ensuring she stays in a clean and stress - free environment. At the start of the 2nd trimester a second installment of the surrogate compensation would be released. This is followed by final payment at the beginning of the 3rd trimester.
Most importantly, we will be providing support in co-ordination with the clinic, immigration authorities in arranging a passport and VISA for the newborn as well as continual news & guidance to both the IPs and the Surrogate Mother will be given.
After IPs leave the country, Surrogacy Abroad would continue to look after the Surrogate Mother. We have a range of options that allow parents to "return the favor" and ensure that the surrogate is not simply used as a means of delivering a baby. We have an established relationship with some local NGO's and use these organizations to deliver suitable aide to each Surrogate Mother rather than giving her the entire lump sum. (Please take note that these arrangements are over and above the standard Surrogate Compensation that will be made after the confirmation of pregnancy.
To enable a smooth and hassle free process, we would obviously need to take care of certain documents.

Our information-gathering processes are effective in selecting egg donors and surrogates. The lengthy application requires the applicant for egg donation or surrogacy to examine her own views and thoughts about the path ahead of her, in addition to providing extensive medical history about herself and her family. Following the written application and in addition to the other screening procedures, prospective surrogates visit with agency personnel several times so that we may gain insight into their personality. We take this time to explore the emotional needs and other expectations the surrogate may have. We visit with egg donors as well, with a view towards satisfying ourselves that a donor candidate can and will comply with the rigorous medication protocol.
Once intended parents commit to working with us for surrogacy, we discuss with them at length their thoughts and feelings about what they are looking for in a surrogate; their views about multiple birth, selective reduction, and termination of pregnancy.
We will then establish communication between IPs (Intended Parents), Surrogates, Egg Donor and the clinic to come-up with a Plan to co-ordinate IP's visit, Surrogate and ED (Egg Donor) cycles.ST

STAGE 1 - CONTACT PROCESS/MEDICAL COUNSELLING
On receiving your inquiry, depending on your needs, we will co-ordinate your case with the clinic, surrogates, egg donors and other professionals involved in the process.
We will provide a first free no-obligation medical opinion through our partner IVF clinic (within 12 hours).
If you decide Surrogacy Abroad can help you further. We will then start the process of locating and screening an Egg Donor and Surrogate that suits your needs.
While all this is happening, Surrogacy Abroad would be working in the background to get contracts ready and signed by all concerned parties, establishing escrow accounts, etc.1 point
