my female friend has filed 498a & DV on her husband.  I feel it is a case of ego clash, both are working and earning handsome salary.  Marriage lasted less than a year.

On my insistence, my female friend is ready to go for MCD with a nominal one time settlement.  She is only demanding for return of dowry, which her father had given to her husband at the time of marriage.

Now the boy is refusing to pay a single penny, saying he is ready to go to jail but will not pay a single penny to my friend.

I am confused what should be my friend's next course of action.  Please advice what should i recommend my friend now.

As a friend I guess your first step is to listen both the sides of the stories and do not suggest anything. The first year of marriage is very important. People take time to know each other. Hope the issues are not happening coz of you in both of them. Meaning hope her hubby does not feel that you and she may have you know what I mean. If tht is not the case, as a friend to both of them, get both of them sit face to face, and speak out their issues in front of you. I suggest a counsellor would be best. But the very best thing is both of them needs to think like adults sit together and get the issues sorted out. Its very early to think abt these things.

Or let us know in details whats the main issue has caused for her to think she needs a divorce?>

@ Riya ...once 498a & DV have been filed the marriage story is over, period!!

@ pep_victim - Mostof us have heard of Bhramhaasthras or the Nuclear Bombs rt? When are they used? - Isn't it supposed to be used only and only in the worst case situations? Legally 498 & DVs are equivalent to these - before these are filed there is a lot of thought to go in, which I guess was not and was filed to teach a lesson upon the instigation of Cops, Lawyers & aquaintances- how would you have reacted if you your Mom, Dad & Sister were all made Criminals and arrested just because of EGO issue??

Because of such kinds of dire misuse of Laws which directly indirectly is insulting the Constitution of India and the law makers, protectors and enforcers doing nothing about it the boys who are common Indian citizens but litrate are all set to fight back...going to the prison is only the begining....of the fight...the attack is yet to begin and once it starts all support systems would be routed...which could include you too (who as per your profile is also a 498, DV, etcs victim and has fallen for another misuser of law just because she is a lady friend)....when ever there has been public injustice there has been mahabharath....where karan, dhron, bhishma were killed to breach the support system using all methods including thos of the likes of Ashvadhama...which in your case could probably include getting your wife into to ruin you and your that female friend....everything is fair in a war and in this its a personal, religious, social, legal & psycological battle...and her husband woudl use that same dowery to fund his that battle....

...so I would advice you to back off before you get struck....unless you are ready to bear the damages her husband cause to you....

Do you understand helping a criminal is also a crime...in the eyes of the law? Misusing the Law is a crime...misusing the law is also disrespecting the Constitution of India which is also criminal...which your this friend has committed due to EGO...supporting her makes you too one!! - So advice you to back off in this case. You claim yourself to be a victim but other guys they are bad eh??

Yes tomorrow you come across an innocent lady who was being tortured by a visous husband &/ his folks - in such a case help! Don't fall for crocodile tears!

why are you ashamed to tell that it is your case rather than making it as my female friend etc...I know it is very difficult to express but first come out of it, Khulke duniya ke samne bolo ki biwi ne aisa atyachar kiya, Taking her back will be a suicide for you.

thankx pakkya, riya and buzz..............belive me it's not my story..............it's my classmates story well mine story i keep writing on my threads!  it's just that  my classmate and I are facing the same sad story.

I do agree that the gal's side has filed 498a, DV against the boy...............but indirectly i am helping the boy.

After much persuasion,  I am successful in changing the gal's mind, now she wants quick divorce from that boy and she is not interested in litigation anymore, without any maintenance or permanent alimony.  She just want the dowry back, which her father had given to groom.

And i feel that my friend's husband is smart enough.   I am sure he is a member of legalservicesindia.com

So my friends dont you think I am doing a noble job.

to help is a good thing..but to help the right one in a right manner is the best..

Since cases have been filed it would be really hard to lighten up the issues and make thm simple again..but still communication might help as it could save time , money and energy of both the sides..
